The National Assembly Elections Petition Tribunal sitting in
Kaduna has upheld the election of Barrister Mohammed
Musa Soba, Daily Post reports.
Soba contested the election to represent Soba Federal
Constituency on the platform of the All Progressives
Congress (APC) and was declared winner after supposedly
polling more votes to defeat Barrister Ibrahim Khalid
Mustapha of the Peoples Democratic Party (PDP).
Barrister Mustapha, however, challenged the election of
Soba at the election tribunal on the grounds that he gave
false information to the Independent National Electoral
Commission (INEC) and also did not resign his employment
with the National Drug Law Enforcement Agency (NDLEA)
before contesting the election.
But in a ruling yesterday, October 8, the court dismissed
the petition.
Delivering judgement after reviewing evidence, Justice Paul
Uche Uhuo under the chairmanship of the tribunal Justice
Abdulhamid Mohammed Yakubu, dismissed the petition for
lack of merit.
The order of the judgment reads: “All things considered,
this issue is resolved against the petitioner.
“The 1st respondent eminently qualified to contest the
election of 28th March, 2015 for Soba Federal
Constituency.
“Prayers of the petitioner to this tribunal to order for
nullification and conduct of fresh election for Soba
Federal constituency is hereby refused.
“Declaration of Barrister Mohammed Musa Soba by INEC
as the winner of the said election and duly elected is
hereby affirmed.
“The petition lacks merit and is hereby dismissed and we
make no order as to cost.”
Soba’s triumph comes just hours after the PDP suffered
another defeat at the tribunals as the National Assembly
Elections Petition Tribunal sitting in Minna, Niger state
upheld the election of Alhaji Lado Abdullahi of the APC.
